These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “customer,” or “user”) and NUNCHUKX LLC, a New Jersey limited liability company (“NUNCHUKX,” “we,” “us,” or “our”), governing your access to and use of nunchukx.com (the “Site”) and any services or purchases made through the Site.

By accessing the Site or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site immediately.

2. Eligibility

By using this Site, you represent and warrant that:

  • You are at least 18 years of age;
  • You have the legal capacity to enter into a binding contract; and
  • All information you provide is accurate, complete, and current.

3. Modifications to Terms

We reserve the right to update, modify, or replace these Terms at any time without prior notice. Updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Site following any changes constitutes your acceptance of the updated Terms.

4. Products & Availability

All products, descriptions, pricing, and availability on the Site are subject to change without notice. We make reasonable efforts to display accurate product information; however, color and detail accuracy may vary based on individual displays and device settings.

We reserve the right to:

  • Limit quantities;
  • Modify or discontinue products;
  • Correct errors, inaccuracies, or omissions; and
  • Adjust pricing at any time.

5. Orders

Your order constitutes an offer to purchase. We reserve the right to accept or reject any order for reasons including, but not limited to:

  • Suspected fraud or unauthorized activity;
  • Inaccurate information provided by you;
  • Inventory or pricing errors; or
  • Compliance with applicable laws and regulations.

If an order is canceled after payment is received, you will receive a full refund for the canceled order.

6. Pricing & Payment

All prices are shown in United States Dollars (USD). We currently accept payments through Shopify Payments, which may include credit and debit cards, Apple Pay, Google Pay, Shop Pay, and other methods supported by Shopify Payments.

We do not currently support:

  • Afterpay;
  • Klarna; or
  • Other installment providers not listed as available at checkout.

All payments are securely processed by third-party payment processors that comply with PCI-DSS standards. NUNCHUKX does not store or have direct access to your full payment card information.

7. Shipping & Delivery

7.1 Shipping Location

All orders ship from New Jersey, USA.

7.2 Carriers

We use the following carriers:

  • Within the United States: UPS and USPS;
  • International: UPS and DHL.

7.3 Customer Responsibility

You are responsible for providing a complete and accurate shipping address. We are not responsible for losses, delays, or misdeliveries resulting from incorrect or incomplete addresses provided by the customer.

7.4 Risk of Loss

Risk of loss transfers to the customer once the package is successfully handed to the carrier, as confirmed by carrier acceptance scans. After the carrier marks the package as “Received,” “Accepted,” or an equivalent status, NUNCHUKX is no longer responsible for loss, theft, or damage.

7.5 Lost or Damaged Packages

If a package is lost or damaged in transit:

  • We will assist you in filing a claim with the carrier; however,
  • NUNCHUKX is not liable for carrier-related losses and cannot guarantee reimbursement.

Customers must cooperate with carrier investigations, including providing any requested information or documentation, in order to qualify for any potential resolution.

8. Returns, Exchanges & Final Sale Policy

Because NUNCHUKX operates in limited-edition drops and small-batch apparel production, all sales are final unless otherwise explicitly stated on the product page or at checkout.

Exceptions may apply only when:

  • The item arrives defective or damaged; or
  • An incorrect item was shipped.

Claims must be submitted to support@nunchukx.com within 7 days of delivery and must include clear photos and a description of the issue. NUNCHUKX reserves the right to determine whether a replacement, store credit, or other remedy is appropriate.

9. Promotions & Discount Codes

Promotions, discount codes, and special offers are subject to their own terms and conditions and may be modified or discontinued at any time. Unless otherwise stated, promotions cannot be combined, applied retroactively, or used on previous purchases.

NUNCHUKX reserves the right to interpret, limit, or revoke any promotion or discount in cases of suspected misuse or abuse.

10. Site Conduct & Prohibited Uses

When using the Site, you agree not to:

  • Engage in fraudulent, abusive, or unlawful activity;
  • Circumvent or attempt to circumvent security features of the Site;
  • Interfere with or disrupt the operation of the Site or its servers;
  • Upload or transmit viruses, malicious code, or harmful content;
  • Extract, scrape, or harvest content or data from the Site without permission; or
  • Use the Site to violate any applicable law or the rights of any third party.

Violation of these rules may result in suspension or termination of your access to the Site and may also result in legal action.

11. Intellectual Property Rights

All content on the Site—including designs, logos, images, product names, graphics, text, and other materials—is the exclusive property of NUNCHUKX LLC or its licensors and is protected by intellectual property laws.

You may not, without our express written consent:

  • Copy, reproduce, or redistribute Site content;
  • Use our branding or content for commercial purposes;
  • Create derivative works based on our designs or materials; or
  • Use our trademarks, logos, or trade dress in a way that may cause confusion.

Unauthorized use of our intellectual property may result in legal action and claims for damages.

12. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.

13. Disclaimer of Warranties

The Site and all products are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

  • The Site will be uninterrupted, secure, or error-free;
  • Any defects will be corrected; or
  • Product descriptions, images, or other content are entirely accurate, complete, or current.

14. Limitation of Liability

To the fullest extent permitted by New Jersey law, NUNCHUKX LLC shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or related to:

  • Your use of or inability to use the Site;
  • The purchase, use, or inability to use any products;
  • Shipping delays, carrier issues, or lost packages;
  • Loss of data, profit, revenue, or goodwill.

In all cases, our total liability to you for any claim arising out of or relating to an order or the Site shall not exceed the amount you actually paid for the order at issue.

15. Indemnification

You agree to indemnify, defend, and hold harmless NUNCHUKX LLC, its owners, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the Site or products;
  • Your violation of these Terms; or
  • Your infringement of any third-party rights, including intellectual property or privacy rights.

16. Governing Law

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law principles.

17. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or your use of the Site:

  1. The parties agree first to attempt to resolve the dispute through good-faith negotiation.
  2. If the dispute cannot be resolved through negotiation, it shall be submitted to mediation in New Jersey.
  3. If the dispute remains unresolved after mediation, it shall be finally resolved through binding arbitration conducted under the rules of the American Arbitration Association (AAA), to the fullest extent permitted by law.

You agree to waive the right to participate in any class action lawsuit or class-wide arbitration against NUNCHUKX LLC, and any claims must be brought on an individual basis.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
